The Legal Right to Care for a Child
Guardianship gives a person the legal right to care for and make decisions for a child whose parents are absent, inattentive or neglectful. Perhaps a parent is overseas for an extended amount of time as a member of the military. Perhaps a parent is in rehab for a drug addiction. Perhaps both of the parents have simply gone away and left the child behind. Regardless of the situation or the form of child neglect that has taken place, legal guardianship is critical.

How the Courts Determine Whether Guardianship Should Be Granted
When the courts are presented with a request for guardianship, they have one important question that needs to be answered: what is in the best interest of the child?
The courts want to know that granting guardianship will be truly beneficial to the child. Ideally, they want to see children remain in the care of their parents. However, they understand that situations arise in which staying with parents is either not possible or potentially harmful to the child. In these situations, they will grant guardianship.
I will assist in the preparation of all necessary documents to show the courts that awarding guardianship to you would truly be in the best interest of the child.
Guardianship is Handled in Probate Court
Guardianship is a unique family law matter, in that it is not handled in the same court system as other family law matters. It is handled in probate courts. This court system has different rules.
