In California, child support is calculated by using a software program incorporating the statewide uniform guideline formula. A variety of input numbers are entered into the formula and used to calculate the amount of guideline support payable by one party to the other.

Factors Entered Into the Child Support Formula

The two most important factors entered into the child support formula are the amount of time each parent has with the child and the income of each parent. If the custodial parent spends significantly more time with the child, that may be reflected in a higher child support payment. If the custodial parent has a much higher income, that may be reflected in a lower child support payment.

There are other factors included in the calculation of child support that should not be overlooked. These factors include: health insurance premiums, mortgage interest, property tax deductions, retirement fund contributions (both mandatory and voluntary) and day care.

Child Support in Divorce and Paternity Cases

While the issue of child support most frequently arises in relation to divorce, it is also an issue that needs to be addressed by unmarried parents in relation to paternity cases. My experience allows me to handle both types of child support cases.
