Rapper DMX taken into custody over unpaid child support

California celebrity watchers may not be surprised to learn that rapper DMX, whose real name is Earl Simmons, was taken into custody on Oct. 27 after he was accused of failing to pay his child support. He was reportedly ordered to pay $10,000 per month to his ex-wife and mother of four children in 2014.

The 44-year-old stated in court on the same day that he was taking steps to settle his legal problems. He stated that he was performing at advertised shows that could potentially lead to larger venues and the money to pay off his debts. He argued that if he remained in jail, he would have no way to pay off those debts. His ex-wife’s attorney asked the judge to impose some sort of bail on the rapper to ensure that he returns to court, although the judge did not do so.

His next court date is scheduled to be on Nov. 18. The rapper’s attorney stated that his goal was to continue working so that he could pay off the debts that he owed with the help of his new management team.

When a parent is awarded child support, there is usually a formula involved that helps the courts determine how much the non-custodial parent should pay the custodial parent. This formula is often based on income. However, the non-custodial parent’s income could change, making it difficult to pay the amount that was awarded to the other parent. If financial circumstances change, an attorney may request that the amount of support that is owed each month be reduced based on a new calculation of child support. This way, the non-custodial parent can continue to provide some support without becoming overly burdened.
